Shared Custody admin, June 20, 2024February 15, 2025 This is a recent case where the parties had shared custody of one child under a parenting order. The child was starting school and the father proposed that the child attend school in Sudbury. He moved to change the original parenting order. Daigle v. August 22, 2023 Family law — Children — Parties sharing parenting of their one child pursuant to order after separating — With child about to start school, father seeking review of order and proposing child attend school with Aboriginal focus in Sudbury — Mother proposing that child attend school in small First Nation community — Father’s motion to amend granted — Both parties had presented sound plans and demonstrated that they were able to care for child and to make decisions together — Evidence showed that child had more settled and developed ties to community of Sudbury and had been attending daycare where school was located — It was in child’s best interests to reside with his father and attend school in Sudbury but with as much meaningful contact with his mother as possible.
